SMS Terms and Conditions

This page outlines the terms and conditions that apply when a consumer provides their cellular phone number and consents to receive SMS messages, also referred to herein as “text messages,” from Generate Mortgage Company and its agents and/or representatives (collectively referred to as “Generate Mortgage”). For purposes of these SMS Terms and Conditions, the system used to transmit and manage text messages shall be referred to as the “Text Messaging System.”

Generate Mortgage may use text messages to inform consumers about promotional opportunities and/or mortgage- or loan-related information. These messages are intended solely for the recipient, are confidential between Generate Mortgage and the recipient, and are not a promise to extend credit or a requirement for any application for an extension of credit.

Message frequency varies. Message and data rates may apply.


Consent to Contact:

By providing your phone number and opting in, you are providing express written consent for Generate Mortgage Company, its employees, agents, or representatives to contact you regarding your inquiry via text message, email, or phone (including calls to a cellular number or other service for which you may be charged).

This contact may include the use of an automatic telephone dialing system and/or an artificial or prerecorded voice or message. Message frequency varies. Message and data rates may apply.

You expressly consent to being contacted by Generate Mortgage via any means at any telephone number you provide, even if your number is listed on any internal, corporate, state, or national Do Not Call Registry. Consent is not required as a condition of utilizing Generate Mortgage’s services.

You may opt out of receiving calls or electronic communications at any time by making a Do Not Call request.

By opting in to receive text messages from Generate Mortgage, you represent that:

  • You are the account holder for the phone number provided,
  • You are legally authorized to consent to receive or send text messages under applicable local, state, or federal laws, and
  • You will use the Text Messaging System solely to communicate with Generate Mortgage.

No Obligation to Purchase or Guarantee of Credit:

Consent to receive text messages from Generate Mortgage does not obligate you to purchase any product or service and is not a condition of credit approval or any loan transaction.

Text messages and/or phone calls from Generate Mortgage are not an offer or guarantee to extend credit or a commitment to lend.

All loans are subject to credit approval and program guidelines.


Privacy:

By opting into receiving SMS messages, you agree to the terms of Generate Mortgage’s Privacy Policy. Please refer to our Privacy Policy page for more information regarding how your information is collected, used, and protected.


Disclaimer:

You understand and agree that Generate Mortgage is not responsible for issues arising from:

  • Defects in the Text Messaging System,
  • Your use of the Text Messaging System,
  • Use of your phone or cellular account by you or any third party, or
  • Your cellular service provider.

Generate Mortgage does not guarantee that text messages (sent or received) are secure, accurate, or complete. Text messages may be intercepted, corrupted, delayed, or disrupted by external factors beyond our control.

Generate Mortgage disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose relating to the Text Messaging System.

It is not our policy to request nonpublic personal information via text message. PLEASE DO NOT SEND NONPUBLIC PERSONAL INFORMATION VIA TEXT MESSAGE. If you need to transmit nonpublic, sensitive personal information, please contact our office directly at: (678) 210-3578 or support@generatemtg.com.


Indemnification:

By opting in to receive text messages and/or interacting with the Text Messaging System, you agree to indemnify and hold harmless Generate Mortgage, its employees, agents, and affiliates from any third-party claims arising from your use of the Text Messaging System, including but not limited to claims under the Telephone Consumer Protection Act (“TCPA”).


Consumer Obligations in Case of Phone Number Change: 

If you change your phone number or surrender ownership of the number you provided Generate Mortgage Company, you agree to immediately notify Generate Mortgage Company of that change by emailing support@generatemtg.com so that we may deactivate your number. You also agree to indemnify Generate Mortgage Company, its employees, agents and affiliates against any and all claims that arise as a result of your failure to notify Generate Mortgage Company of that change, including damages, expenses, penalties and legal fees that may arise. This includes but is not limited to claims arising out of the Telephone Consumer Protection Act (“TCPA”).


Report Abuse:

If you did not sign up for text messages, your cellular phone or cellular account has been compromised, you discover that an unauthorized 3rd party is using your account to contact Generate Mortgage Company, or if you believe your number has been registered with Generate Mortgage Company as a result of any abusive or criminal activity, please inform our Customer Service Department immediately by calling (678) 210-3578 or emailing support@generatemtg.com.


Removal / Opting Out from Text Messaging:

If you no longer wish to receive text messages or communications from Generate Mortgage Company, you may opt out at any time by sending the command STOP to the number that you received from Generate Mortgage Company, or by contacting us (678) 210-3578 or by emailing support@generatemtg.com. All requests to opt out will be honored within a commercially reasonable amount of time.


Complaints:

Complaints regarding Generate Mortgage Company’s text messaging system, or any exchanges between you and a representative or agent of Generate Mortgage Company via the text messaging system should be submitted to (678) 210-3578 or by email at support@generatemtg.com.


Available Text Commands:

While individual text messages from Generate Mortgage Company may contain specific command instructions, the following commands may be used at any time to interact with the SMS text messaging system:

STOP: By texting STOP to the number that you received from Generate Mortgage Company, your number will be removed from text messaging notifications and campaigns.

START: By texting START to the number that you received from Generate Mortgage Company, you can re-enroll in messages.

HELP: By texting HELP to the number that you received from Generate Mortgage Company, you will be able to access information and help.


Language:

Generate Mortgage Company’s products and services are offered only in English. Any translations of text messages into other language are intended solely as a courtesy, and not an indication that an application for credit or loan transaction may occur in that language. If there is any discrepancy between the content of a text message communication from Generate Mortgage Company in a language other than English, the English version will control.


Disputes:

By providing your phone number for use with the Text Messaging System, you agree that the laws of the State of Georgia shall govern these Terms and any dispute arising from them. Any action relating to the Text Messaging System shall be brought in the state or federal courts located in Georgia. You consent to personal jurisdiction in such courts. Claims may also be subject to arbitration as permitted by applicable law.


Severability:

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Why is Generate Mortgage Company sending me text messages?

When you provide Generate Mortgage Company with your number and consent to receive SMS or text messages, we may use text messages to inform you about promotional opportunities and/or mortgage-related information.


How do I stop receiving text messages?

You may unsubscribe from text messages offered by Generate Mortgage Company at any time by texting the word STOP to the number from which you received the message, by calling (678) 210-3578, or by emailing our Customer Support Department at support@generatemtg.com


What if I have questions about the text messages?

You may text the word HELP to the number from which you received the message to receive assistance with the text messaging system. If you have questions about the information, you received or would like to speak to a customer service representative, please call (678) 210-3578 or email support@generatemtg.com or more information.


I am a victim of identity theft and did not sign up for texts. What can I do?

If you did not enroll your cell phone number and believe you are receiving messages from Generate Mortgage Company as a result of identity theft, unauthorized, or criminal activity, please contact our Customer Support Department by calling (678) 210-3578 or emailing support@generatemtg.com or further assistance.


Is there a charge for the text messaging service?

Generate Mortgage Company will not charge you to send or receive messages with us. However, your individual cellular phone carrier’s messaging or data rates may apply.


How often will I receive messages from Generate Mortgage Company?

The frequency of messages will vary depending on our products and marketing campaigns. If you find the messages to be too frequent, you may opt out by texting STOP to the number from which you received the message, calling (678) 210-3578, or emailing support@generatemtg.com


I sent an opt-out request but have changed my mind. How do I re-enroll?

If you wish to start receiving text messages again, you may text START to the number from which you received the message and you will be re-enrolled in messaging communications.


How long will it take to remove me after I opt out?

We will honor all opt-out requests and remove your number within a commercially reasonable amount of time. Opt-out requests sent to our Customer Support Department via email or phone on holidays or weekends may take additional time to process. Please note that after you submit your request, you may continue to receive messages that were scheduled for delivery prior to your request being processed. If you believe your opt-out request has not been honored, please escalate the matter by calling (678) 210-3578 or emailing support@generatemtg.com.


What commands can I use with the text messaging system?

STOP: Text STOP to the number from which you received the message to unsubscribe from text messaging notifications and campaigns.

HELP: Text HELP to the number from which you received the message to receive assistance and additional information.

START: Text STARTto the number from which you received the message to re-enroll in text messaging communications.


Will signing up for texts make it more likely that I will qualify for a mortgage?

No. Opting in to receive text messages from Generate Mortgage Company will not make it more likely that any loan application will be approved and is not a requirement for credit approval.
